Canceling a new timeshare purchase in Texas.

This page is about the short cooling-off right on a new purchase. Getting out of a timeshare you have owned for years is a different service. Nothing here is legal advice, and Timeshare Cancellation Partners is not a law firm.

The statutory window

Before the sixth day after the later of the day you sign and receive a copy of the purchase contract, or the day you receive the required timeshare disclosure statement.

When the clock starts. Whichever of those two events is later. The statute is written as “before the sixth day,” not as a loose “six full days.”

How notice is treated. Follow the cancellation instructions in the contract and keep proof of sending.

Checked 2026-10-26 against Tex. Prop. Code § 221.041. Statutes are amended. Your contract can give you longer than the statute. Confirm both before you rely on a date.

What to do if the purchase is recent

  1. Find the cancellation address in the contract. Do not use the sales desk’s verbal instructions as a substitute.
  2. Send a short writing that says you cancel, names the contract, and is signed. Keep a copy.
  3. Use the delivery method the contract, or the statute, treats as effective. Certified mail is often safer than a regular email even when email is allowed.
  4. Do not sign a waiver of your cancellation right while the window might still be open.
  5. Do not stop there if a closing already happened. Some statutes treat an early closing as voidable for much longer, and that question belongs with a lawyer.

If you have owned it for years

This statute will not unwind an old purchase. The later path is the contract you have now: maintenance, any loan, the term, and whether the developer offers a real release. That review is the contract-cancellation service, not this page.

Bring the contract, not a theory.

A case review starts with the resort, the year you signed, and where the fees stand. Any fee for later work is explained in writing before it begins.
